On August 13, the Ohio Supreme Court threw out a petition for a constitutional amendment regulating dialysis treatment pricing in Ohio. The issue will not appear on the November ballot.
The constitutional amendment was designed to limit the amount clinics can charge to 115% of their costs. Ohio has approximately 18,000 dialysis patients.
The Court ruled unanimously that because paid organizers of the petition gathering operation didn’t make required disclosures to the Ohio Secretary of State’s office before gathering the signatures, all signatures must be thrown out.
The deadline for filing ballot measures for the Tuesday, November 6, election was July 4.
Critics of the proposal said the amendment, if passed, would have reduced access to dialysis treatment. Critics also felt such a measure had no place as an amendment to the state constitution.
