Hamilton County Common Pleas Court Judge Christian Jenkins issued a preliminary injunction on October 7 to indefinitely block Senate Bill (SB) 133, the “heartbeat” abortion ban. He had previously extended a temporary restraining order against enforcement through Wednesday, October 12.
In remarks from the bench after a daylong hearing in Preterm-Cleveland v. Yost, Judge Jenkins said SB23 creates “great difficulty” for Ohio practitioners and puts them in a “terrible position.” He added that the Ohio Constitution “confers a fundamental right on all Ohioans to privacy, procreation, bodily integrity, and freedom of choice in healthcare decision making that encompasses the right to abortion.” More extensive findings of fact and conclusions of law are forthcoming, but Judge Jenkins found “abortion is safe healthcare to which Ohio women have a right.”
